Our Legal Process
We guide you through every stage of your matter, from initial consultation to final resolution, ensuring a clear, structured, and efficient approach at each step.
Step 1 – Initial Contact
We discuss your situation, confirm how we may assist you, and provide an estimate and a costs agreement for your matter.
Step 2 – Initial Correspondence
We communicate with the other party or their legal representatives to outline your position and explore whether the matter can be resolved early.
Step 3 – Exchange of Financial Disclosure
Both parties are required to exchange relevant financial information and documents. Your duty of disclosure is ongoing until the matter is finalised.
Step 4 – Mediation or Alternative Dispute Resolution
Where appropriate, we will arrange mediation or arbitration to attempt to resolve the dispute without commencing court proceedings.
Step 5 – Pre-Action Procedures
If the dispute cannot be resolved, the parties must usually comply with pre-action procedures before commencing court proceedings.
Step 6 – Filing Court Documents
Court proceedings are commenced by filing the necessary applications and supporting documents with the Court.
Step 7 – First Court Event
The Court will list the matter for a first hearing, where procedural directions are made to progress the case.
Step 8 – Interim Hearing (if required)
If urgent or temporary issues arise, the Court may conduct an interim hearing to determine temporary arrangements.
Step 9 – Court-Ordered Dispute Resolution
The Court may direct the parties to attend conciliation conferences, mediation, or other dispute resolution processes to encourage settlement.
Step 10 – Final Hearing
If the dispute remains unresolved, the matter proceeds to a final hearing, where the judge hears evidence and legal arguments from both parties.
Step 11 – Judgment or Consent Orders
The Court will deliver a judgment, or the parties may reach an agreement resulting in consent orders.
Step 12 – Implementing Orders or Appeal
The final step involves implementing the court orders. In some circumstances, a party may also consider appealing the decision.
